If a Residence Permit Extension Is Refused in Finland: Work and Appeal Rules

If your Finnish residence permit extension is refused, the effect on your right to stay and work depends on the decision, whether a removal decision is included, and whether you appeal. Do not assume that a negative decision always ends the right to work immediately.

Apply for an extended permit before the current permit expires

For work-based permits, Migri states that you should apply for an extended permit before your current permit expires. If you apply in time, you may usually continue working in accordance with your current permit while the application is being processed. If you apply only after the previous permit has expired, the old permit does not normally give you a continuing right to work.

If the extended permit is refused

Where a negative extended-permit decision also includes a deportation decision, Migri currently states that the right to work continues until the deportation decision becomes enforceable. In the situation described in Migri's current guidance, this means the right to work ends 30 days after service of the deportation decision. The actual decision and appeal instructions must always be read carefully because individual cases can differ.

Changing employer or field of work

A change of employer does not always have the same effect as a change of field. Migri's current extended-permit guidance explains that a new job in a different field may require an extended permit even while the previous permit is still valid. If the new job is in a different field, you are usually not allowed to continue working in that new field while the application is pending unless another right to work applies.

Appeal and a new application are different routes

An appeal challenges the existing decision. A new application asks the authority to assess a new or changed factual situation. Which route is appropriate depends on the refusal grounds, the appeal deadline, new evidence and the applicant's current right to stay and work.

Always follow the appeal instructions attached to the decision and the current Migri guidance. ENB Consulting is not a public authority and does not guarantee an outcome.
